Terms of Use

These Terms of Use ("Terms") govern your use of shoutfire.com (the "Site"), operated by Shoutfire, a sole proprietorship owned by Stephen Houser in Edmond, Oklahoma ("Shoutfire," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Drone, mapping, and other paid work is governed by the written agreement or quote for that job, not by these Terms.

1. Use of the Site

1.1 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to view and use the Site to learn about and contact us about our services.

1.2 Restrictions. You may not: (i) copy, republish, sell, or commercially exploit the Site or its content, including photos, video, 3D models, and maps, except as these Terms allow; (ii) download or extract 3D models, imagery, or other files from the Site for reuse; (iii) disassemble or reverse-engineer any part of the Site; (iv) scrape the Site or use it to build a competing product or service; or (v) interfere with the Site, its servers, or its contact form, including by sending spam or automated submissions. All copyright and proprietary notices must stay intact.

1.3 Changes. We may change, suspend, or discontinue any part of the Site at any time, without liability to you.

1.4 Ownership. The Site and its content, including text, design, photos, video, 3D models, orthomosaic maps, and the Shoutfire name and logo, belong to Shoutfire or its licensors and are protected by copyright and trademark law. All rights not expressly granted are reserved.

1.5 Feedback. If you send us feedback or suggestions about the Site, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without attribution.

2. Information on the Site

Service descriptions, starting prices, examples, and measurements shown on the Site illustrate our work and are not a quote or an offer. Prices and turnaround for your job are set in the written quote or agreement for that job. Example measurements come from photogrammetry and are not a licensed land survey, and our imagery documents conditions; it is not a roof inspection, rating, or certification.

3. Messages, calls, and texts

When you contact us through the form, email, phone, or text, you agree that we may reply by the same means. Calls to our number may be answered by an AI voice agent, and a summary or transcript is sent to us so we can follow up, as described in our Privacy Policy. Please do not send us confidential or sensitive information, such as payment card numbers, through the contact form.

4. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what we collect, including through Google Analytics cookies, and how we use it. It is part of these Terms.

5. Third-party sites

The Site links to third-party sites and services, such as Droners.io and Google. We do not control them and are not responsible for their content or practices. Your use of them is governed by their own terms.

6. Indemnification

You agree to defend, indemnify, and hold harmless Shoutfire and Stephen Houser from any claims, losses, and reasonable costs and attorneys' fees arising out of your misuse of the Site, your violation of these Terms, or your violation of any law.

7. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SHOUTFIRE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CODE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) SHOUTFIRE WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, OR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE OR THESE TERMS; AND (B) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SITE OR THESE TERMS WILL NOT EXCEED $50. THESE LIMITS DO NOT APPLY WHERE THE LAW DOES NOT ALLOW THEM.

9. Termination

We may suspend or end your access to the Site at any time, including if we believe you have violated these Terms. Sections 1.2 through 1.5 and 4 through 11 survive.

10. Governing law and disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at hello@shoutfire.com and give us 30 days to try to resolve it informally. Any dispute that is not resolved will be brought only in the state or federal courts located in Oklahoma County, Oklahoma, and you and we consent to their jurisdiction. Either party may bring an individual claim in small claims court.

11. General

Changes to these Terms. We may update these Terms by posting a new version here and changing the date at the top. Continued use of the Site after changes are posted means you accept them.

Electronic communications. You agree to receive communications from us electronically, and that they satisfy any legal requirement for written notice.

Accessibility. We want the Site to work for everyone and aim to meet WCAG 2.1 Level AA. If anything on the Site is hard to use, contact us and we will help.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Shoutfire about the Site. If any provision is unenforceable, it will be modified to the minimum extent needed, and the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent.
